Terms of Service

These Terms of Service (“Terms”) govern your use of Evolution (the “Service”), an invoice-management platform operated by our company. By creating an account or otherwise using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. Accounts
You are responsible for the activity that happens under your account and for keeping your credentials secure. You must provide accurate information when you register and keep it up to date. We may suspend or terminate an account that is used in violation of these Terms or applicable law.
Accounts come in several roles — client, staff accountant, firm owner, and platform admin. Certain features are available only to certain roles.
2. Your content
You retain all rights to the invoices, bank statements, messages, and other content you upload or generate in the Service (“Your Content”). You grant us a limited licence to host, process, transmit, and display Your Content for the purpose of operating the Service for you — including running the automated extraction and matching features described in the app.
You are responsible for having the rights to the content you upload and for making sure it does not infringe anyone else’s rights or break any law.
3. Acceptable use
You agree not to use the Service to:
- Break any law or infringe anyone’s rights.
- Upload malware, illegal content, or content you do not have the right to upload.
- Attempt to access another workspace, tenant, or account that you are not authorised to use.
- Reverse-engineer, scrape, or attempt to extract the Service’s source code beyond what is expressly permitted by law.
- Interfere with the Service’s normal operation, for example by overloading our infrastructure or probing it for vulnerabilities without a prior written agreement.
4. Subscriptions and billing
Some features are available only on paid plans. Paid plans are billed through Stripe. Fees, billing cycles, and included limits are shown in the Service at the time of purchase. Unless stated otherwise, fees are non-refundable once a billing period has started.
We may change pricing or plan features with reasonable notice. If you do not accept a change, you may cancel before the next billing cycle.
5. Automated processing
The Service uses automated systems (including third-party AI models) to extract data from invoices, match transactions, and generate suggestions. These outputs are estimates and can be wrong. You are responsible for reviewing automated output before relying on it — in particular, before filing anything with tax or other authorities.
6. Privacy
Our Privacy Policy explains what information we collect and how we use it. By using the Service you consent to the practices described there.
7. Service availability
We aim to keep the Service available and reliable, but we do not guarantee uninterrupted operation. The Service is provided “as-is” and, to the maximum extent permitted by law, without warranties of any kind. We may change, suspend, or discontinue features with reasonable notice.
8. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill arising out of your use of the Service. Our total liability for any claim arising out of or relating to the Service is limited to the amount you paid us for the Service in the twelve months before the event that gave rise to the claim.
9. Termination
You can stop using the Service at any time. We may suspend or terminate your access if you break these Terms or use the Service in a way that risks harm to us or to other users. After termination you can request deletion of your data as described in the Privacy Policy.
10. Governing law
These Terms are governed by the laws of the Netherlands, without regard to its conflict-of-law rules. Disputes that cannot be resolved informally will be submitted to the competent courts of the Netherlands, unless mandatory consumer-protection rules in your country of residence apply.
11. Changes to these Terms
We may update these Terms from time to time. When we make material changes we will update the “Last updated” date above and, for significant changes, notify you in the app or by email. Your continued use of the Service after an update constitutes acceptance of the revised Terms.
